ANALISIS KEPASTIAN HUKUM AKTA TERHADAP KEWENANGAN NOTARIS DALAM PELAYANAN BERBASIS ELEKTRONIK (CYBER NOTARY)

Abstract

The phenomenon of the Covid-19 virus outbreak and the development of Information and Communication Technology have an impact on the field of Notaries law in Indonesia. This can be seen in the discourse on the operation of Notaries in electronic based services (cyber notary). This research is mean to know how the legal certainty of Notaries deeds generated through electronic concepts (cyber notary) and whether the legal concsequences for Notaries that did electronic make a deed (cyber notary). This research method employed normative jurdical law and used literature approaches and legislation approaches. The data source used was primary material, secondary law ingredient, tertier legal material. Data collection techniques are conducted by study of literature and review literature and conduct an inventory of legislation regulation. Research indicates that the deeds of a Notaries in electronic based services (cyber notary) are not yet of strong legal certainty because of conflicting laws betwen laws, so the certainty of the legal papers of e Notaries is Made through electronic concepts (cyber notary) is consistent with the legal certainty of the deeds under his had. And as result of the law on the Notaries which Made the electronic based (cyber notary) which consisted of the deeds could go down as the deed under his had, the lawsuit to the Notaries no security so as to be subject to alternations, compensation and potential sanctions of Notaries termination.
