KONSINYASI PENITIPAN UANG GANTI RUGI PADA PENGADILAN NEGERI TANJUNGPINANG TERHADAP PEMBEBASAN LAHAN UNTUK KEPENTINGAN UMUM DALAM

Abstract

In this case the District Court acts as the recipient of the Consignment of Safekeeping for Indemnity as in Presidential Regulation No. 36/2005 in conjunction with Presidential Regulation No. 65 of 2006 regulating the institution for depositing compensation money to the District Court (consignment), namely in Article 10 paragraph (2) of Presidential Regulation No. 65 of 2006 stated that "If after a deliberation is not reached an agreement is reached, the Land Procurement Committee determines the amount of compensation and entrusts compensation money to the District Court whose jurisdiction covers the location of the land concerned, the purpose of this study is to review and examine the mechanism for compensating for the procurement of the implementation land acquisition for development in the public interest in the District Court and To find out the legal implementation of the court ruling in consignment of custody of compensation for land used for Development II of Tread Tower No. 14 150 KV Transmission Batam - bintan, as for the theory used is a theory i consignment, the research method used is a normative juridical research method that is a study besides looking at the positive legal aspects also looking at its application or practice in the field. Based on the results of the study that the mechanism of compensation for the consignment of land used for the Construction of II Tread Tower No. 14 Transmission 150 Batam-Bintan is caused by the absence of a meeting point, so that the process in the court is the one who can complete, the consignment activities by the PLN carried out on the basis -as stated in article 42 of Law Number 2 of 2012 based on article 42 paragraph (2) which contains what conditions are permitted for the government to carry out land consignment activities
