PENEGAKAN HUKUM PIDANA TERHADAP PENJUAL OBAT SECARA ONLINE

Abstract

Cytotec is a drug that contains misoprostol as the active ingredient. Cytotec is available in tablets of 100 mcg and 200 mcg. Cytotec drug works by reducing gastric acid levels so as to prevent injury to the gastric mucosa (gastric ulcer), and the cytotec drug belongs to the hard drug class. So the purchase must use a doctor's prescription. Cytotec has dangerous side effects when used not in accordance with a doctor's prescription, so that from the side effects of this drug, the sellers are selling this drug as an abortion drug. The formulation of the problem in this study is to find out how the provisions for the use and distribution of Cytotec drugs online are based on Law Number 36 of 2009 concerning Health and how to enforce criminal law against online cytotec drug sellers based on Law Number 36 of 2009 concerning Health. This research method uses empirical research methods using qualitative data analysis. The conclusion of this study is that basically the sale of Cytotec drugs online is illegal in accordance with the circulation provisions that have been made by BPOM and also in accordance with Law No. 36 of 2009 concerning Health. Very high technological advances that allow anyone to buy these drugs online, this is one of the obstacles to law enforcement efforts. So that law enforcement efforts must be carried out so as not to increase the sale of Cytotec drugs online.
