Abstract

Subsidized Home Ownership Loans are housing facilities support for low-income communities carried out by the Ministry of Public Works and People's Works. to overcome the occurrence of default (bad credit) on a Home Ownership Credit Agreement. The problem that arises is related to the way that is done by the parties. Different ways of course the result of different laws. The purpose of this study was to analyze the juridical settlement of non-performing loans for subsidized housing using the credit transfer method at the State Savings Bank of Tanjungpinang City. The theory used in this research is the theory of the principle of contractual freedom and the principle of pacta sunt servanda. The research method used by the researcher is a normative legal research method. The approach to be used. In this study, the statute approach is carried out by reviewing all laws and regulations related to legal issues that are currently dealing with the problem of solving subsidized home ownership credit problems with credit transfers at the Tanjungpinang City State Savings Bank with the knowledge of the bank is legal, both parties continue to carry out their respective rights and obligations. The operation of underhanded subsidized home ownership loans from a legal perspective is not justified and is an act against the law. Subsidized housing is a debt guarantee object for the debtor to the Bank, so that the Bank can sue the debtor for compensation for the purchase of a mortgage house by the old debtor which was carried out under the hands and immediately pay off all the remaining debt.
