Abstract

Copyright as an intagible asset can be used as a fiduciary guarantee, which is in the 2014 statute on copyright 28. The role of the assessors society is needed very much in determining copyright values that are used as fiduciary bail objects. However the absence of appraisal is become the barrier of making the copyright as guarantee’s objects. Using a comparative approach, by compared appraisal in USA and Australia as reference for Indonesia having appraisal institute for copyright with a purpose to inform that how much important the role of appraisal in prescribe the value of copyright build upon PP Permenkeu No. 228/PMK.01/2014 about Appraiser where the public appraisal can prescribe the value of object based on the classification of service as what contained in Decision of the Chairman of the Capital Market and Financial Institution Supervisory Agency Number KEP 620/BL/2011 concerning Guidelines for Valuation and Presentation of Intangible Assets Valuation Reports in the Capital Market as the basis for assessing copyright as an intangible asset to be used as an object of fiduciary security. Using comparative law theory to illustrate how regulations where copyright can be used as an object of fiduciary guarantees can be implemented with the establishment of an appraisal agency that can be carried out well, as well as the United States and Australia which have succeeded in imposing copyright as an object of guarantee by having their own appraisal agency
