Abstract

Consumers are every person who uses goods and/or services available in the community, whether for self-interest, family, other people and so on. In today's era, buying and selling transactions, especially property such as houses, shop houses, warehouses and furniture, and so on have occurred very much, especially in the Tanjungpinang City area. Of the many buying and selling transactions, there are often transactions for property goods that contain hidden defects, which are carried out by business actors with the motive of obtaining more profit from the sale proceeds. Therefore, related to these problems, with the existence of Law Number 8 of 1999 concerning Consumer Protection which aims to provide protection for the rights of consumers who are harmed by business actors, the problem is how to protect consumers in property sales agreements that contain defects. hidden and how to resolve consumer disputes over the sale and purchase of properties that contain hidden defects. The purpose of this paper is to find out how consumer protection is in the sale and purchase agreement of property goods that contain hidden defects, to find out the settlement of disputes in the property sale and purchase agreement that contains hidden defects. The method used is normative research using a qualitative approach by referring to informants from the head of the BPSK secretariat of the Tanjungpinang City Consumer Dispute Resolution Agency as a consumer dispute resolution agency. The results of this study from 2019-2020 BPSK Tanjungpinang City succeeded in resolving disputes over buying and selling property that contained hidden defects and succeeded in protecting consumer rights for losses suffered by consumers as users of goods and/or services to be used by consumers. Then regarding the dispute resolution of the property sale and purchase agreement that contains hidden defects through the consumer dispute settlement agency (BPSK) through mediation, the consumer party wins and the business actor agrees to replace the damage suffered by the consumer.
